Terms of reservation and stay

§1. Definitions

  1. Owner — Marcin Dancewicz, doing business under the name Expanding Web Marcin Dancewicz, ul. Malinowskiego 1, 59-600 Lwówek Śląski, Tax ID (NIP): PL6161455447, REGON: 369984358 — operating the short-term rental of the “Stara Piekarnia” property.
  2. Property — the holiday home “Stara Piekarnia” at Jaśkiewicza 9, 59-600 Lwówek Śląski (entry from Ogrodowa street).
  3. Guest — a natural person making a reservation and staying at the Property.
  4. Reservation — the short-term rental agreement between the Owner and the Guest on the terms set out in these Terms.
  5. Terms — this document, which forms an integral part of the agreement.

§2. Scope

  1. These Terms set out the rules for reservation, payment, stay, and cancellation of the rental of the Property.
  2. Making a Reservation is equivalent to having read and accepted these Terms.
  3. These Terms constitute a contractual model within the meaning of art. 384 of the Polish Civil Code.

§3. Reservation and conclusion of the agreement

  1. A Reservation is made via the form on stara-piekarnia.com/en/, providing: full name, email address, phone number, stay dates, number of guests, and accepting these Terms.
  2. After submitting the form, the Guest is redirected to secure payment handled by Stripe Payments Europe Ltd.
  3. The agreement is concluded once the full payment has been recorded by the payment provider. The Guest receives a confirmation at the email address provided.
  4. Minimum stay: 2 nights.
  5. The Property can accommodate up to 6 guests. The number of people actually staying at the Property must not exceed the number declared in the Reservation.

§4. Price and payment

  1. The current rate is 600 PLN gross per night, regardless of the number of guests (up to the limit stated in §3).
  2. The total price is the rate multiplied by the number of nights. It includes: utilities (electricity, water, heating), Wi-Fi, linen, and towels.
  3. Payment is made 100% in advance, at the time of Reservation, via Stripe (credit/debit card, Google Pay, Apple Pay, BLIK, Przelewy24).
  4. The Owner does not collect an additional deposit; the Guest is liable for damages under the rules in §7.
  5. VAT invoice / receipt — on the Guest’s request, the Owner will issue an accounting document based on the details provided in the Reservation.

§5. Changes and cancellations

  1. The Guest may cancel the Reservation at any time by sending an email to: rezerwacje@stara-piekarnia.com.
  2. The amount of the refund depends on when the cancellation is made:
    • More than 14 days before arrival — 100% refund.
    • Between 7 and 14 days before arrival — 50% refund.
    • Less than 7 days before arrival — no refund.
  3. Refunds are issued to the same card / account used for payment, within 14 days of receiving the cancellation request.
  4. A change of stay dates is possible with the Owner’s consent, subject to availability and without additional fees, provided the request is received at least 14 days before the original arrival date.
  5. The Owner may withdraw from the agreement in the event of force majeure (technical failure, unforeseen event). In such a case, the Guest receives a full refund.
  6. The 14-day right of withdrawal provided by the Polish Consumer Rights Act does not apply to short-term rental services — in accordance with art. 38 item 12 of that Act.

§6. House rules

  1. Check-in: from 3:00 PM on the day of arrival. Check-out: by 11:00 AM on the day of departure. Individual times — by arrangement.
  2. Quiet hours: 10:00 PM to 7:00 AM.
  3. Smoking is allowed only on the terrace. Smoking inside the Property is strictly prohibited (including e-cigarettes).
  4. Pets are welcome at no additional charge. The Guest is fully responsible for their behaviour and any damage caused.
  5. Loud parties, weddings, or other events that violate quiet hours or public order are prohibited.
  6. The Guest undertakes to use the Property for its intended purpose, maintain order, and observe fire safety regulations.
  7. Keys received from the Owner must be returned on the day of departure. Loss of a key will result in the cost of a lock replacement.

§7. Liability and damages

  1. The Guest bears material liability for any damage to furnishings, technical equipment, and the Property itself, caused by the Guest or persons staying with the Guest.
  2. Any damage noticed on the day of arrival must be reported to the Owner immediately — otherwise it is assumed to have occurred during the stay.
  3. The Owner is not liable for items left at the Property after departure, nor for valuables not entrusted to the Owner for safekeeping.
  4. The Owner is not liable for interruptions in utilities arising from causes beyond the Owner’s control (power grid or water supply failures, etc.).

§8. Complaints

  1. Complaints concerning the quality of the service should be reported promptly after the event, during the stay — this allows the Owner to address them.
  2. Written complaints should be sent to: rezerwacje@stara-piekarnia.com, no later than 14 days after the end of the stay.
  3. The Owner will review the complaint within 14 days of receipt.
  4. A Guest who is a consumer may use out-of-court dispute resolution methods, including the European Commission’s ODR platform: ec.europa.eu/consumers/odr.

§9. Protection of personal data

The rules for processing the Guest’s personal data are set out in a separate document: Privacy Policy.

§10. Final provisions

  1. Matters not covered by these Terms are governed by Polish law, in particular the Civil Code and the Consumer Rights Act.
  2. The court with jurisdiction over disputes is the court competent for the location of the Property. For disputes with consumers — the court competent under general rules.
  3. The Owner reserves the right to amend these Terms. Amendments do not apply to Reservations already made.
